A Nurse Peer Review is a process within a hospital that determines whether a nurse has violated the Nurse Practice Act. If a Nurse Peer Review Committee determines that a nurse has violated the Nurse Practice Act the committee next decides if it was a minor incident or one that should be reported to the Nursing Board. If a nurse is reported to the Nursing Board they will be subjected to a disciplinary process, so it is important that a nurse undergoing a peer review vigorously defend themselves.
Registered Nurses (RN) and Nurse Practitioners (NP) are entitled to a Nurse Peer Review Hearing in hospitals that employ over 15 nurses when there has allegedly been a violation of the Nurse Practice Act. The most frequent allegations comprising such violations are quality of care issues, drug violation or abuse and drug diversion and HIPPA violations, to name but a few. The guidelines for conducting such hearings are found in the Nurse Practice Act and the Board's rules. If a nurse receives notification of a pending peer review meeting, the nurse should immediately contact lawyer Jeffrey Grass to obtain advice. An adverse finding by a Nurse Peer Review Panel may lead to the termination of the nurse, an HIPDB report, a report to other nurse clearing house data bases, the Healthcare Resources and Services Administration (HRSA) and to the NCSBN service for employers, Nursys — Nurse Licensure Verification.
